The spouse who files for divorce—or dissolution of marriage–is known as the Petitioner. The Petitioner is the spouse who begins the filing procedure with the family law or domestic relations court.

The non-filing spouse is known as the Respondent. The Respondent is the spouse who does not file the initial dissolution of marriage papers, but instead receive the filing papers, and is issued a summons by the court.
In order to file for divorce, otherwise technically known as dissolution of marriage in the state of Washington, residency must be proven. The court must have jurisdictional rights to hear the case or it will be dismissed sooner or later. A good lawyer can help.

In Seattle dui and criminal related news, Seattle’s Komo News reported a story today, December 8, 2009, began with these words, ‘My Brother Had Tire Tracks on his chest.’ Lindsay Cohen wrote the story.
According to Cohen, the family of a man killed in a hit-and-run by a suspected drunk driver cried out in anguish on Monday as the driver stood before the judge. A relative of Jerome Dumlao yelled, “Murderer! You killed my brother. He’s not coming back.” The family of Dumlao clung to one another. Los Angeles news:DUI Arrest For Baywatch Star’s Ex

In Los Angeles David Hasselhoff’s ex-wife, Pamela Bach, was arrested this week on suspicion of drunken driving in Los Angeles. Last Saturday night, November 28, 2009, she was pulled over by the California Highway Patrol, just south of U.S. 101 on Laurel Canyon Boulevard.
According to CHP Bach had blood alcohol levels of .14 and .13, a breathalyzer test showed. The legal limit is .08.in California. She was booked at the Van Nuys jail and released. Bach was also required to attend a treatment program. She was required to not drive with any measurable amount of alcohol in her blood. Well, I am sure she has both a good probate and dui attorney.

Bach and David Hasselhoff were married for 16 years. He filed for divorce in 2006. The two met when she appeared in a few episodes of Hasselhoff’s series, “Baywatch.”

She is scheduled to appear in court on Dec. 24.

Former Attorney Gen. Aide Faces Legal Charge

Just got back from sunny San Diego and am ready to get blogging. Phil Kline was attorney general and Eric Rucker was Kline’s chief of staff at the time Rucker has been alleged to have violated his professional ethics.
IU wonder if he will need adivorce attorney next. Eric Rucker is facing a complaint filed by the state’s judicial disciplinary administrator. The complaint filed this week alleges that Rucker presented inaccurate details before the Kansas Supreme Court about Kline’s investigation of abortion clinics. A judicial ethics panel will hold a hearing into the charges against Rucker in April. The panel will decide if Rucker violated professional ethics. If he is disciplined, the Supreme Court will determine punishment. It could range from a slap on the hand to disbarment.
Rucker has been unavailable for comment since charges were filed on Monday. Phil Kline is now teaching law at a Virginia university. He said the complaint reveals more about the motives of the Supreme Court than it does about Rucker.
Kline was quoted in an article written by David Klepper for the Kansas City Star. In the online post on November 25, 2009, Kline reportedly said, “The court has silenced a key witness to criminal activity by Kansas abortion providers and thwarted a legitimate investigation and prosecution for violation of Kansas law,” Kline wrote in an e-mail. “Mr. Rucker has served Kansas honorably and honestly.… ”. I suppose some could argue that this is an issue anywhere in the country, whether it be Overland PArk, Kansas City, Boston or wherever.

Miami Commissioner Pleads Guilty To Charge

Angel Gonzalez has entered a plea of guilty to a misdemeanor charge. According to the charge, Gonzalez used his position to get his daughter a job with a construction company that she was not required to even show up for. This is the guy who appoints the Florida District Attorney? According to an article written by Miami Herald writer, David Ovalle, dated November 16, 2009, titled, Disgraced Miami commissioner pleads guilty to the criminal misdemeanor charge, the head of Delant Construction, Juan Delgado, hired Gonzalez’s daughter, Elizabeth Gonzalez, and payed her $500 per week. She was paid $47,000 between July 2004 and May 2005 for doing no work. Elizabeth, who is 28 years old, faces no charges. Atlanta News Cites Hot Tub Injury Study

Atlanta’s online news site (cbsatlanta.com) printed an article quoting a statistic that 6,600 people suffer various forms of serious injury in hot tubs each year! The article cites a new study by the Center for Injury Research and Policy. The report’s shocking findings are that the number of hot tub injuries doubled from 1990 to 2007!
Slipping and falling caused half of the injuries. 73% of the people hurt were older than 16 years old, the study reported. Elder Abuse Results in Fine for Placerville Pines Care Center in California

Placerville Pines Care Center has been fined $100,000 for its responsibility in the death of an elderly resident, and also issued an AA citation from the state of California, which is the most severe penalty imposed under the law. These citations were announced by the director of the California Dept. of Public Health, who in a news release reported that the center failed to assess the health of the patient or notify the doctor of a change in the residents condition. This failure to properly notice health changes or report to the doctor contributed to the death of the patient according to the Department. There are a variety of actions that are considered nursing home abuse or “elder abuse,” ranging from not feeding or providing medication on a timely basis to shackling or horrific physical abuse such as beatings or assault. In California, laws are strict when it comes to nursing facilities and all must comply with state and federal laws. There are separate regulations that cover health care facilities that nursing homes must also adhere to. When a nursing home fails to follow these regulations or laws, the state may impose fines that range from $100 for a class B
violation to $100,000 for a class AA violation.
To the residents of these facilities, fines mean nothing. Oakdale Plane Crash Prompts Lawsuit Against Aviation Companies

A plane crash that took the lives of two people in 2006 in Oakdale has prompted a lawsuit against four aviation companies by surviving family members. Dave Mesenhimer and Chuck Billington, both residents of Modesto, took off from Modesto airport on February 8th, 2006 in a Zodiac airplane, only to crash 18 minutes
later as they attempted to land at the Oakdale airport. Mesenhimer, a pilot for several years, was co-founder of the Modesto Flight Center. His passenger, Billington, sat on the Modesto Irrigation District Board of Directors, and was a well-known local businessman who owned three manufacturing plants in the area. The day the fatal crash occurred, Billington was in the process of renewing his pilot’s license. The man that Billington had purchased the Zodiac plane from had built the aircraft from a Zenith Aircraft kit.
Families of both men are now suing Zenith Aircraft Company, Zen air and Quality Sport Planes. These companies were involved in the making, selling or promotion of the kit. According to Zenith Aircraft, their belief is that the accident occurred due to negligence on behalf of the victims, and they have responded to the lawsuit. They purport that the two men knew the risks of flying the plane. In the lawsuit filed by the family of the victims, damages are sought for funeral and burial expenses, as well as wrongful death and financial support. Punitive damages are also being sought by the families.
The NTSB has since grounded the two seater plane the victims were traveling in, and according to investigations the Zodiac CH-601 had numerous design defects that could potentially cause the wings to break. 8 additional people have since died in crashes related to the Zodiac aircraft.

San Francisco’s Neighbor to Be In Television Spot

The television NBC show called, “Trauma” which had an ample supply of personal injury related cases, has been canceled, but one more episode will still be produced, and it will be shot in Oakland, California. Oakland will be the scene of a staged for TV bank robbery. There will be actors in the uniforms of paramedics, cops, and they will be playing FBI agents, and news reporters with news vans. All in all, the episode in question will be called, Tunnel Vision, and will be produced between 7 a.m. and 5 p.m. today and tomorrow. The TV chaos will be filmed at the corner of 21st Street and Broadway. Chicago: Wrestler Suing After Stairs Collapse

Jennifer Fernicola issued a report today November 11, 2009, in the Hot Topics section of the online publication, Chicago Now, under the title, Pro Wrestler sues after he falls out of the ring.
Apparently, the stairs leading from the wrestling ring collapsed under professional wrestler Gregory Lee as he left the ring. He is suing Windy City Pro Wrestling. In the complaint that was filed last July, the wrestler was in a wrestling entertainment event held at Toyota Park in Bridgeview. The stairs to the ring collapsed and Lee suffered personal injured in a fall. I am sure he will be looking for a good personal injury lawyer.
All in all, Lee contends that Windy City Pro Wrestling was also negligent when it, “failed to adequately light the catwalk and stairs leading from the wrestling ring.” The third defendant in Lee’s case is the Village of Bridgeview because it helped in the building of the stairs and catwalk.
