The spouse who files for divorce—or dissolution of marriage–is known as the Petitioner. The Petitioner is the spouse who begins the filing procedure with the family law or domestic relations court.

The non-filing spouse is known as the Respondent. The Respondent is the spouse who does not file the initial dissolution of marriage papers, but instead receive the filing papers, and is issued a summons by the court.
In order to file for divorce, otherwise technically known as dissolution of marriage in the state of Washington, residency must be proven. The court must have jurisdictional rights to hear the case or it will be dismissed sooner or later. A good lawyer can help.
To fulfill the requirements you must:
•	Be a resident of the state
•	Be a member of the armed forces and stationed in this state
•	Be married to a party who is a resident of this state or who is a member of the armed forces and is stationed in this state. If you happen to need a top Washington divorce lawyer then I do suggest this resource.
Ninety days must elapse from the time the petition for a dissolution of marriage is filed until the court will act upon the petition by issuing a summons on the respondent. (Revised Code of Washington – Title 26 – Chapters: 26.09.010, 26.09.030). Make sure to get a good lawyer for this kind of thing.

In Seattle dui and criminal related news, Seattle’s Komo News reported a story today, December 8, 2009, began with these words, ‘My Brother Had Tire Tracks on his chest.’ Lindsay Cohen wrote the story.
According to Cohen, the family of a man killed in a hit-and-run by a suspected drunk driver cried out in anguish on Monday as the driver stood before the judge. A relative of Jerome Dumlao yelled, “Murderer! You killed my brother. He’s not coming back.” The family of Dumlao clung to one another. Another family member lashed out, crying, “Murderer!” If you decide that you require a first rate Seattle DUI attorney I do sugges this law firm. They are dui specialists ans can provide a top attorney.Eric Murillo, 23 years old, is believed to have been driving drunk when he allegedly ran over Dumlao. The family says Dumlao was crossing the street at the intersection of Bell and Western around 2:25 a.m., following a night out with his friends when he was struck and killed on Sunday.
His family said Dumlao, a local FedEx driver, had gotten married the previous year. He was looking forward to starting a family.

In Los Angeles David Hasselhoff’s ex-wife, Pamela Bach, was arrested this week on suspicion of drunken driving in Los Angeles. Last Saturday night, November 28, 2009, she was pulled over by the California Highway Patrol, just south of U.S. 101 on Laurel Canyon Boulevard.
According to CHP Bach had blood alcohol levels of .14 and .13, a breathalyzer test showed. The legal limit is .08.in California. She was booked at the Van Nuys jail and released. As a breif aside if you find yourself needing a first rate Los Angeles probate attorney then allow me to suggest this law firm. Robert Mansell is simply a leading probate attorney and can assist you in many southern California communities and not only in the Los Angeles city area. Now back to the big story:
In 2007, Bach was charged with misdemeanor hit-and-run. The charges were dropped in an agreement in which was required to pay minor damages to the woman whose car she hit. Bach did not contest a drunken driving charge in August. According to court records she was placed on three years of informal probation
Bach was also required to attend a treatment program. She was required to not drive with any measurable amount of alcohol in her blood. Well, I am sure she has both a good probate and dui attorney.

Bach and David Hasselhoff were married for 16 years. He filed for divorce in 2006. The two met when she appeared in a few episodes of Hasselhoff’s series, “Baywatch.”

She is scheduled to appear in court on Dec. 24.

Just got back from sunny San Diego and am ready to get blogging. Phil Kline was attorney general and Eric Rucker was Kline’s chief of staff at the time Rucker has been alleged to have violated his professional ethics.
IU wonder if he will need adivorce attorney next. Eric Rucker is facing a complaint filed by the state’s judicial disciplinary administrator. The complaint filed this week alleges that Rucker presented inaccurate details before the Kansas Supreme Court about Kline’s investigation of abortion clinics. And if you require a good San Diego divorce attorney then this Law Firm may be for you. They do all sorts of family law related cases instead of being just divorce attorney only. They can also assist you with various tax issues if you reside in the Kansas City area and not just in Overland Park exclusively.
The complaint further alleges that Rucker used statistics he knew were inaccurate to support the investigation during his arguments before a district court judge.
A judicial ethics panel will hold a hearing into the charges against Rucker in April. The panel will decide if Rucker violated professional ethics. If he is disciplined, the Supreme Court will determine punishment. It could range from a slap on the hand to disbarment.
Rucker has been unavailable for comment since charges were filed on Monday. Phil Kline is now teaching law at a Virginia university. He said the complaint reveals more about the motives of the Supreme Court than it does about Rucker.
Kline was quoted in an article written by David Klepper for the Kansas City Star. In the online post on November 25, 2009, Kline reportedly said, “The court has silenced a key witness to criminal activity by Kansas abortion providers and thwarted a legitimate investigation and prosecution for violation of Kansas law,” Kline wrote in an e-mail. “Mr. Rucker has served Kansas honorably and honestly.… ”. I suppose some could argue that this is an issue anywhere in the country, whether it be Overland PArk, Kansas City, Boston or wherever.

Angel Gonzalez has entered a plea of guilty to a misdemeanor charge. According to the charge, Gonzalez used his position to get his daughter a job with a construction company that she was not required to even show up for. This is the guy who appoints the Florida District Attorney? According to an article written by Miami Herald writer, David Ovalle, dated November 16, 2009, titled, Disgraced Miami commissioner pleads guilty to the criminal misdemeanor charge, the head of Delant Construction, Juan Delgado, hired Gonzalez’s daughter, Elizabeth Gonzalez, and payed her $500 per week. She was paid $47,000 between July 2004 and May 2005 for doing no work. Elizabeth, who is 28 years old, faces no charges. As an aside if you do need a Florida criminal attorney then I should suggest David GArvin. Simply put, he is a leading tax and criminal related attorney for Miami, Fort Lauderdale and the state of Florida generally. Although prosecutors were unable to establish a direct pay-off to Delant Construction, Gonzalez did vote favorably for the company in his role as commissioner.
Meanwhile, Juan Delgado, who was formerly leader of the Latin Builders Association, is facing charges of fraud in another otherwise unconnected Florida related criminal corruption case, was granted immunity for his cooperation in the Gonzalez case. Wow, these guys will really keep the attorney folk busy tight.

Atlanta’s online news site (cbsatlanta.com) printed an article quoting a statistic that 6,600 people suffer various forms of serious injury in hot tubs each year! Head injury is very common, for example. No wonder so many folks are hiring an injury lawyer these days. In any event, the article called, Hot Tubs Hurt 6,600 People Each Year, was posted November 3, 2009, and was featured in the health column.
The article cites a new study by the Center for Injury Research and Policy. The report’s shocking findings are that the number of hot tub injuries doubled from 1990 to 2007!
Slipping and falling caused half of the injuries. 73% of the people hurt were older than 16 years old, the study reported. Cuts on the legs, serious cuts on the feet, and cuts on the head made up most of the problems along with head injury. Lara McKenzie, the author of the study, warned that children suffer near drownings, and that fact needs to be made aware of, as well. 6 to 12 year old children were also apt to be injured jumping or diving into hot tubs. As an aside if you require a tip top Atlanta injury lawyer then James Rice is your man. He can help with various accident situations along with catastrophic injury and spinal cord $ head injury as well. He is simply one of Atlanta’s best lawyer for these types of cases.
McKenzie and the other authors recommended using slip-resistant surfacing in and around hot tub. It is also important, they said to limit exposure to 10 to 15 minutes. The tub should not exceed 104 degrees. Hot tubs should always be kept covered with a locking mechanism when they are not being used.
McKenzie said also, that parents should consider using fencing or barriers to keep children out of the hot tub area, and they should set forbidding jumping and diving. They should also comply with suction cover standards as this can cause accident and serious injury.
The CBSAtlanta article also said that, “The study was based on data in the National Electronic Injury Surveillance System, which is operated by the U.S. Consumer Product Safety Commission.” It was published in the online issue of the American Journal of Preventive Medicine.

Placerville Pines Care Center has been fined $100,000 for its responsibility in the death of an elderly resident, and also issued an AA citation from the state of California, which is the most severe penalty imposed under the law. These citations were announced by the director of the California Dept. of Public Health, who in a news release reported that the center failed to assess the health of the patient or notify the doctor of a change in the residents condition. This failure to properly notice health changes or report to the doctor contributed to the death of the patient according to the Department. There are a variety of actions that are considered nursing home abuse or “elder abuse,” ranging from not feeding or providing medication on a timely basis to shackling or horrific physical abuse such as beatings or assault. In California, laws are strict when it comes to nursing facilities and all must comply with state and federal laws. There are separate regulations that cover health care facilities that nursing homes must also adhere to. When a nursing home fails to follow these regulations or laws, the state may impose fines that range from $100 for a class B
violation to $100,000 for a class AA violation.
To the residents of these facilities, fines mean nothing. Being the victim of abuse is something that elderly people should not have to endure, and certainly isn’t the way they expect to be treated during their golden years. Severe physical abuse or neglect can often lead to trauma, and often the victims do not report these abuses to members of their families when they can. California
nursing home abuse lawyers know that families are often not aware that their loved one is being treated badly or abused for weeks or even months. When questioned about the abuse of their family member, staff members have often practiced abuse on a regular basis and are able to make excuses for nearly any sign
of abuse. According to the National Center of Elder Abuse, there are some signs you should
look for to determine if your loved one is being neglected:
* Look for unchanged or dirty clothes and other signs that good hygiene is not in
practice.
* Find out when your loved one is receiving proper medical care and medications on
a timely basis.
* Weight loss, thirst and other signs of malnutrition or dehydration should be
looked into.
* Look for signs of assaults or physical abuse, as well as bed sores. Question
your loved one about any bad treatment.
* Search for symptoms of fear, depression or anxiety in a loved one.

A plane crash that took the lives of two people in 2006 in Oakdale has prompted a lawsuit against four aviation companies by surviving family members. Dave Mesenhimer and Chuck Billington, both residents of Modesto, took off from Modesto airport on February 8th, 2006 in a Zodiac airplane, only to crash 18 minutes
later as they attempted to land at the Oakdale airport. Mesenhimer, a pilot for several years, was co-founder of the Modesto Flight Center. His passenger, Billington, sat on the Modesto Irrigation District Board of Directors, and was a well-known local businessman who owned three manufacturing plants in the area. The day the fatal crash occurred, Billington was in the process of renewing his pilot’s license. The man that Billington had purchased the Zodiac plane from had built the aircraft from a Zenith Aircraft kit.
Families of both men are now suing Zenith Aircraft Company, Zen air and Quality Sport Planes. These companies were involved in the making, selling or promotion of the kit. According to Zenith Aircraft, their belief is that the accident occurred due to negligence on behalf of the victims, and they have responded to the lawsuit. They purport that the two men knew the risks of flying the plane. In the lawsuit filed by the family of the victims, damages are sought for funeral and burial expenses, as well as wrongful death and financial support. Punitive damages are also being sought by the families.
The NTSB has since grounded the two seater plane the victims were traveling in, and according to investigations the Zodiac CH-601 had numerous design defects that could potentially cause the wings to break. 8 additional people have since died in crashes related to the Zodiac aircraft.
Over the last few decades, deaths due to airplane crashes have lessened significantly. Newer planes are much safer than those of past decades, and also faster. Even with improving statistics, each year there are still hundreds of people killed in both private and commercial aircraft. However, the past year has
proven to be a particularly bad one for aviation safety, with several accidents involving commercial planes in the US being reported, not to mention the high profile incident in the Hudson River. California
airplane accident attorneys remain concerned about this issue, particularly because of the higher risk of fatal injuries when accidents do occur. When a commercial plane is involved in a crash, it often leads to hundreds of deaths. The Reeves Law Group has offices across California, and is dedicated to representing
personal injury victims, including victims of aviation accidents. Please contact us

The television NBC show called, “Trauma” which had an ample supply of personal injury related cases, has been canceled, but one more episode will still be produced, and it will be shot in Oakland, California. Oakland will be the scene of a staged for TV bank robbery. There will be actors in the uniforms of paramedics, cops, and they will be playing FBI agents, and news reporters with news vans. All in all, the episode in question will be called, Tunnel Vision, and will be produced between 7 a.m. and 5 p.m. today and tomorrow. The TV chaos will be filmed at the corner of 21st Street and Broadway. As an aside if you require a wonderful San Francisco personal injury lawyer then may I suggest Scott Righthands firm as he is a leading lawyer for personal injury cases in the bay area in general.
As it now stands, the traffic will be halted to permit shooting intermittently by the real Oakland police, to permit shooting. There will be actors stationed on roofs with phony firearms, and the police are concerned that people know it’s only pretend. The police are concerned that when people see actors in San Francisco SWAT TEAM uniforms, not to mention firemen and paramedics, that will become concerned that there is a real emergency and phone 911. In that case someone just might need a good lawyer you would think.

Jennifer Fernicola issued a report today November 11, 2009, in the Hot Topics section of the online publication, Chicago Now, under the title, Pro Wrestler sues after he falls out of the ring.
Apparently, the stairs leading from the wrestling ring collapsed under professional wrestler Gregory Lee as he left the ring. He is suing Windy City Pro Wrestling. In the complaint that was filed last July, the wrestler was in a wrestling entertainment event held at Toyota Park in Bridgeview. The stairs to the ring collapsed and Lee suffered personal injured in a fall. I am sure he will be looking for a good personal injury lawyer.
All in all, Lee contends that Windy City Pro Wrestling was also negligent when it, “failed to adequately light the catwalk and stairs leading from the wrestling ring.” The third defendant in Lee’s case is the Village of Bridgeview because it helped in the building of the stairs and catwalk. As an aside if you need a great Chicago personal injury lawyer then might I suggest Joh Buden’s practice as he is a highly rated personal injury lawyer for the windy city. meanwhile, In a somewhat unrelated story, the Chicago Sun Times ran a piece today, November 11, 2009, by Mark Brown, titled, Law students’ idea grows into godsend for vets.
